Ailin Terms of Use

1. Agreement to These Terms

These Terms of Use (“Terms”) are a legal agreement between you and the legal operator identified above (“Ailin,” “we,” “us,” or “our”) governing your access to and use of the Ailin iOS application, including its text, audio, exercises, features, free content, and paid content (collectively, the “App”).

By downloading, installing, accessing, purchasing through, or using the App, you agree to these Terms and acknowledge the Ailin Privacy Policy. If you do not agree, do not use the App.

Your use of the App is also subject to:

• Apple’s applicable App Store and Apple Media Services terms; and
• Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”).

These Terms supplement the Apple Standard EULA. They are not intended to replace it or to serve as a custom App Store license agreement. If these Terms conflict with the Apple Standard EULA regarding the license or use of the iOS App, the Apple Standard EULA controls to the extent of that conflict.

2. Eligibility and Age

Ailin is intended for users aged 16 and older. It is not directed to children under 16.

If you are at least 16 but have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and should be involved in your use of the App.

You may use the App only if:

• you can legally enter into these Terms, or a parent or legal guardian validly agrees on your behalf;
• your use is permitted by the laws that apply to you; and
• you comply with these Terms and applicable Apple terms.

3. What Ailin Is

Ailin is a self-guided general-wellness and educational support application. It provides educational explanations, grounding and relaxation exercises, audio practices, sleep-related content, and other self-support materials concerning experiences such as anxiety, panic-like sensations, overthinking, intrusive thoughts, and sleep difficulty.

Ailin does not provide individualized assessment or advice. The App does not know your complete medical history, current condition, medications, personal circumstances, or level of risk.

4. Medical and Professional Boundaries

Ailin is not:

• a physician, psychologist, psychotherapist, counselor, or other licensed professional;
• a medical device or diagnostic service;
• medical or mental-health treatment;
• a substitute for professional evaluation, diagnosis, treatment, or therapy;
• a medication-management service; or
• a promise of a particular health or wellness outcome.

The App does not diagnose any condition and cannot determine whether a symptom is caused by anxiety, panic, a medical condition, medication, substance use, or another cause.

Content describing common anxiety or panic patterns is general education only. It must not be used to rule out a medical problem. In particular, the App cannot determine that chest pain, breathing difficulty, fainting, neurological symptoms, severe agitation, or any other symptom is harmless or caused only by anxiety.

Do not use Ailin to start, stop, reduce, increase, or otherwise change medication or professional treatment. Do not delay or avoid professional care because of information in the App.

Seek advice from an appropriately qualified professional if you have questions about symptoms, diagnosis, medication, treatment, or whether an exercise is suitable for you. Seek prompt medical attention for new, severe, unusual, rapidly worsening, or otherwise concerning symptoms.

5. Emergency and Crisis Situations

Any emergency or crisis contact shown or linked in the App may be operated by an independent third party. Availability, eligibility, hours, languages, confidentiality practices, and emergency-escalation procedures are controlled by that provider, not by Ailin.

6. Using Exercises and Content

Your use of any exercise or audio is voluntary. Use reasonable judgment and choose a safe place and time.

Do not use an exercise:

• while driving, cycling, operating machinery, or performing another task that requires full attention;
• when following the exercise would create a safety risk;
• as a substitute for emergency or professional care; or
• if a qualified professional has advised you not to use that type of exercise.

You may pause or stop an exercise at any time. If an exercise causes significant distress, pain, dizziness, breathing difficulty, disorientation, or other concerning symptoms, stop and seek appropriate help.

Individual experiences vary. A practice that feels useful to one person may not be useful or appropriate for another. Ailin does not guarantee relief, sleep, prevention of panic, symptom reduction, or any other result.

7. Free and Paid Access

The App may offer:

• free content and features;
• an Ailin PRO subscription; and
• an Ailin PRO+ subscription.

The content and features included in each access level are described in the App and on the applicable App Store purchase screen. The purchase screen shown by Apple at the time of purchase controls the subscription name, duration, price, currency, trial or promotional terms, and billing details for that transaction.

Paid access is a license to use the included App content and features while the applicable subscription entitlement remains active. It does not transfer ownership of the App or its content to you.

8. App Store Purchases and Auto-Renewable Subscriptions

8.1 Payment through Apple

All iOS purchases and subscriptions are offered and processed through Apple’s App Store and StoreKit. Apple, not Ailin, processes your payment method and App Store billing.

Prices may vary by country or region, currency, taxes, and Apple storefront. The price and billing period displayed in Apple’s purchase confirmation are the terms that apply to your purchase.

8.2 Automatic renewal

An auto-renewable subscription continues and renews automatically for the selected billing period unless you cancel it through your Apple account before renewal in accordance with Apple’s applicable rules.

Apple charges your Apple account and manages renewal, billing failures, price-change notices, and any consent Apple requires for a price increase.

8.3 Free trials and promotional offers

If Apple displays a free trial, introductory price, or promotional offer, its duration, eligibility, and post-offer renewal price will be shown before you confirm the purchase.

Unless cancelled in time under Apple’s rules, a trial or promotional period may convert to a paid auto-renewable subscription at the price shown in the purchase flow. Eligibility is determined by Apple and the configured offer terms.

8.4 Managing or cancelling a subscription

You can manage or cancel an App Store subscription through your Apple account subscription settings. Deleting the App does not cancel a subscription.

Cancellation normally takes effect at the end of the current paid subscription period, subject to Apple’s terms and applicable law. You generally retain paid access until that period ends unless Apple indicates otherwise.

8.5 Restoring purchases

If the App provides a “Restore Purchases” function, you may use it with the Apple account that made the purchase. Restoration depends on Apple’s transaction records, the active entitlement, device compatibility, and App Store availability.

8.6 Refunds

Refund eligibility and refund processing for App Store purchases are controlled by Apple’s policies and applicable law. Ailin does not receive your full payment-card information and cannot directly issue an App Store refund.

Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot lawfully be limited where you live.

9. License and Acceptable Use

Subject to these Terms, the Apple Standard EULA, and applicable Apple usage rules, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control, including use permitted through Apple-authorized Family Sharing or similar Apple features where enabled.

You must not:

• copy, reproduce, publish, distribute, sell, sublicense, rent, or commercially exploit the App or its content except as expressly permitted by law;
• reverse engineer, decompile, disassemble, attempt to derive source code, modify, or create derivative works from the App, except where applicable law expressly permits it;
• remove or alter copyright, trademark, attribution, or other proprietary notices;
• bypass, defeat, interfere with, or attempt to gain unauthorized access to a paywall, purchase validation, entitlement check, security control, or App function;
• use the App to violate law, infringe another person’s rights, or facilitate harmful or fraudulent activity;
• introduce malware, malicious code, or any mechanism intended to disrupt the App or another system; or
• misrepresent Ailin content as individualized medical advice or as content issued or endorsed by a licensed professional, government authority, Apple, or emergency service.

No provision of these Terms restricts activity that applicable law does not allow us to restrict.

10. Ownership and Intellectual Property

The App and its original software, design, text, audio, artwork, graphics, organization, branding, and other content are owned by or licensed to the legal operator of Ailin and are protected by applicable intellectual-property laws.

“Ailin,” associated branding, and product presentation may be protected names, marks, or trade dress. No right to use them is granted except as necessary for ordinary personal use of the App.

Third-party names, trademarks, services, and resources remain the property of their respective owners. Reference to a third party does not imply sponsorship or endorsement unless expressly stated.

11. Privacy

The Ailin Privacy Policy explains how information is handled in connection with the App and direct communications with us. It forms part of the terms governing your use of Ailin.

The App may generate limited pseudonymous product analytics and crash diagnostics as described in the Privacy Policy. Analytics events may include technical identifiers and interaction measurements for prepared content, onboarding, practices, SOS, Support, Sleep, paywall, and subscription-funnel flows. These measurements are for product improvement and reliability; they are not medical assessments, diagnostic conclusions, emergency monitoring, or individualized professional advice.

The current App is designed to operate primarily on your device and does not require an Ailin account. You are responsible for protecting your device, Apple account, backups, and email account.

12. Third-Party Services and Links

The App may open or reference services operated by third parties, including Apple subscription management, legal pages, or external emergency and crisis resources.

Third-party services are governed by their own terms, privacy policies, availability rules, and operational practices. Ailin does not control those services and is not responsible for their independent acts or omissions.

You must comply with applicable third-party terms when using the App, including the terms governing your Apple account, device, App Store access, internet connection, and any external service you choose to open.

External information, links, telephone numbers, and service availability may change. Ailin may review and update resources, but cannot guarantee that every external service will always be available in every location or language. In an emergency, use the official local emergency service for your physical location.

13. Updates, Changes, and Availability

We may correct, update, add, remove, or change App content or features to improve the App, address safety or legal requirements, maintain compatibility, or continue operating the service.

Some updates may be required for continued use. Older App versions may stop functioning correctly after changes to iOS, StoreKit, App Store requirements, external resources, or device compatibility.

We may suspend or discontinue all or part of the App where reasonably necessary. When a material change affects paid access, we will provide notice or another remedy where required by applicable law or Apple’s rules.

The App, particular content, subscriptions, languages, and external resources may not be available in every country, region, device, or App Store storefront.

14. Suspension and Termination

You may stop using the App at any time. You may remove the App from your device, but removing it does not cancel an App Store subscription.

Your license and right to use the App may terminate if you materially violate these Terms, the Apple Standard EULA, or applicable law. We may take reasonable steps to protect the App, users, intellectual property, and legal rights.

Upon termination, you must stop using the App. Provisions that by their nature should survive termination—including provisions concerning ownership, disclaimers, liability, governing law, and disputes—will survive.

Termination does not remove payment obligations already incurred and does not limit mandatory consumer rights.

15. Disclaimers

To the maximum extent permitted by applicable law:

• the App and its content are provided “as is” and “as available”;
• use of the App is at your own discretion and risk;
• we do not promise that the App will be uninterrupted, error-free, complete, compatible with every device, or continuously available;
• we do not guarantee the accuracy, completeness, or continuing availability of third-party information or services; and
• we disclaim implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, quiet enjoyment, and non-infringement to the extent those warranties may lawfully be disclaimed.

Ailin does not warrant or guarantee any medical, psychological, sleep, safety, or wellness result.

Some countries or regions do not allow certain warranty exclusions. In that case, the exclusions apply only to the extent permitted by the law that applies to you.

Nothing in these Terms excludes or limits a statutory warranty, guarantee, remedy, or consumer right that cannot lawfully be excluded or limited.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Ailin and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, revenue, business opportunity, goodwill, or data, arising from or related to the App.

To the maximum extent permitted by applicable law, Ailin’s total aggregate liability arising from or related to the App or these Terms will not exceed the greater of:

• the amount you paid for Ailin through the App Store during the 12 months immediately before the event giving rise to the claim; or
• USD $100.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits such limitation.

The limitations apply only to the extent permitted by the law that applies to you. They do not reduce any non-waivable consumer remedy.

17. Claims Concerning the App

As between Apple and Ailin, Ailin—not Apple—is responsible for addressing claims concerning:

• the App or its content;
• your possession or use of the App;
• product liability;
• compliance with applicable legal or regulatory requirements;
• consumer-protection or privacy law; and
• a claim that the App infringes a third party’s intellectual-property rights.

This allocation does not create liability beyond what applicable law provides and does not limit any right that cannot be limited.

18. Apple’s Role

These Terms are between you and Ailin, not Apple. Ailin, not Apple, is responsible for the App and its content, subject to the Apple Standard EULA and applicable law.

Apple has no obligation to provide maintenance or support for the App. Questions or complaints about Ailin should be directed to the contact in Section 23.

If the App fails to conform to an applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price for the App as provided in the Apple Standard EULA and applicable Apple terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

Apple and its subsidiaries are third-party beneficiaries of the provisions of these Terms that relate to the App and Apple. Upon your acceptance of these Terms, Apple has the right to enforce those provisions against you as a third-party beneficiary.

Nothing in these Terms states or implies that Apple sponsors, endorses, or provides Ailin’s content.

19. Legal and Export Compliance

You must not use, export, or re-export the App in violation of United States export-control or sanctions laws or the laws of the jurisdiction where you obtained or use the App.

You represent that you are not located in a country or region subject to a comprehensive U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on a U.S. Government list of prohibited or restricted parties.

You must not use the App for a purpose prohibited by applicable law.

20. Governing Law and Disputes

Except where mandatory law provides otherwise, these Terms and any dispute arising from them or the App are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Subject to any right you have under mandatory local law to bring a claim elsewhere, the state and federal courts located in Santa Clara County, California, will have jurisdiction over disputes arising from these Terms or the App.

If you are a consumer outside the United States, you may have mandatory rights under the law of the country or region where you live, including the right to bring proceedings in local courts. These Terms do not take those rights away.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing a formal claim, you and Ailin may try to resolve the issue by written notice to support@ailinlabs.com. This informal step does not prevent either party from seeking urgent relief and does not shorten or waive any legal deadline.

21. Changes to These Terms

We may update these Terms when the App, subscriptions, legal requirements, safety practices, or business operations change.

If a change is material, we will provide notice appropriate to the circumstances, such as by updating the Terms in the App and at the public Terms URL and changing the effective date. Where applicable law requires consent, the change will apply only after the required consent is obtained.

Changes do not retroactively remove rights or remedies that have already accrued. If you do not agree to updated Terms, stop using the App and cancel any active subscription through Apple before its next renewal.

22. General Terms

If a provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of the right to enforce it later.

You may not assign or transfer these Terms except where applicable law permits. We may transfer these Terms as part of a merger, acquisition, reorganization, sale of the Ailin business, or similar transaction, subject to applicable law.

These Terms, the Ailin Privacy Policy, the Apple Standard EULA, and the applicable Apple purchase terms form the agreement governing your use of the iOS App. They do not replace any mandatory rights provided by applicable law.
